Duties of the Custodial Parent

Custody of a minor child is preferably awarded by family courts to both parents, provided that both parties prove to be capable of parenting, responsible and able to care for the child. Custody includes personal care of the child (upbringing, healthcare, care in educational matters), care of the child’s assets and the legal representation of the child. In addition, the custodial parent is entitled to determine the place of residence of the joint offspring and therefore holds the right to determine residence.

 

If the child, as described under the topic of maintenance, lives alternately with both parents, custody lies with the parent with whom the child is staying at the time. Unfortunately, joint custody is not always appropriate, for example if one parent proves to be irresponsible in dealing with children, as our private investigators from Saarbrücken know from their extensive investigative experience.

Criminality Excludes Custody

There are various reasons to award custody to only one parent, for example if one parent is heavily committed professionally, suffers from alcohol or drug dependency, tends towards violence and much more. Criminal tendencies are also a criterion for exclusion. One case example that detective colleagues of Kurtz Detective Agency Saarland solved and which we recently discussed in a small circle:

Exploitation of the Child for Criminal Acts

A divorced couple with a joint minor son: the mother had sole custody, the father a weekly right of access. The latter worked in a car workshop, his hobby: together with his best “mate”, using the home laser printer in his spare time to produce fifty-euro notes (counterfeiting). To the layperson, these “counterfeits” were not recognisable. The father waited until his son visited him and then drove around the city with him. He sent the boy into various shops each time with a fake fifty-euro note to buy small items and have the note changed. In this way, he put the counterfeit money into circulation and got his son and consequently also his ex-wife into trouble. One retailer noticed the fake fifty and detained the boy. The father fled without his son, and the police called by the retailer informed the mother. The police officers assumed that the mother had instigated her son to commit this offence (placing counterfeit money into circulation), as she held custody. The private investigators called in by the child’s mother were able to expose the child’s father, using a trick, for the production of counterfeit money and the distribution of the forged notes.

The fake fifties produced with a laser printer naturally did not withstand a banknote testing device.
